Terms of Use

By downloading, installing, or using the Tiny & Milo app (the "App"), the parent or legal guardian agrees to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

The App is intended for use by children. The contracting party under these Terms is the parent or legal guardian, who must be at least 18 years old and legally able to enter into a binding agreement. By allowing a child to use the App, the parent or guardian accepts these Terms on the child's behalf.

Open Mind Studio LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Tiny & Milo offers an auto-renewable subscription, "Premium Monthly". The following disclosures apply:

• Premium Monthly: 1-month auto-renewable subscription.
• A 7-day free trial is offered to new subscribers. If you do not cancel before the end of the trial, your subscription will automatically convert to a paid subscription.
• Subscription pricing varies by region. The price will be confirmed on the purchase screen before you confirm the transaction. As a reference, the default price is US$4.99 per month.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription by going to your Apple ID account settings on your device after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.

Any unused portion of a free trial period will be forfeited when the user purchases a subscription, where applicable.

Refunds are handled by Apple in accordance with Apple's policies. To request a refund, please contact Apple Support directly. Open Mind Studio LLC does not process refunds for App Store purchases.

Users can restore previously purchased subscriptions on a new device by tapping "Restore Purchases" inside the Parental Settings area of the App.

You agree not to reverse engineer, decompile, disassemble, redistribute, sublicense, modify, or create derivative works of the App, except to the extent expressly permitted by applicable law.

All content within the App — including videos, audio, mini-games, characters, artwork, text, and software — is owned by Open Mind Studio LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Open Mind Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total aggregate liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App at any time by uninstalling it.

These Terms are governed by and construed in accordance with the laws of Georgia, without regard to its conflict of laws principles.

The following terms apply to the App as distributed through the Apple App Store:

• These Terms are concluded between you and Open Mind Studio LLC only, and not with Apple. Apple is not responsible for the App or its content.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims relating to the App or your possession or use of it, including but not limited to product liability claims, consumer-protection claims, or claims that the App fails to conform to any applicable legal requirement.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
